Biography

Andi is a Senior Partner and the Head of the Dispute Resolution, Antitrust & Competition at HHP Law Firm. With more than 20 years of experience, he has broad experience in arbitration (domestic and international), litigation (including employment litigation), PKPU/bankruptcy/insolvency and enforcement of collateral, compliance and investigation, corporate crime investigation, insurance disputes, cybersecurity, administrative proceedings against government agencies and judicial review against the government regulations.

Andi is a registered arbitrator at Badan Arbitrase Nasional Indonesia (BANI), Singapore International Arbitration Center (SIAC) and Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS-SJK).

He is a member of International Insolvency Institute (III). He is also an honorary member to the Emerging Markets and Developing Economies (EMDE) Task Force by the Insolvency Law Academy.

Representative Legal Matters

  • Acting as a lead counsel for a US multinational information technology company in BANI proceedings against the customer regarding unlawful termination of software licensing agreement.
  • Acting as a lead counsel for an Asian-based real estate holding company in BANI proceedings against Indonesian company in relation to the termination of the CSPA and the shareholders agreement. 
  • Acting as a lead counsel for a state-owned company in ICC arbitration proceedings seated in London in relation to an oil & gas concession in the SE Asia region.
  • Acting as a lead counsel for a major PRC real estate company in SIAC arbitration proceedings seated in Singapore in relation to disputes on procurement agreement regarding sale and purchase of various parcels of land in Indonesia.
  • Acting as a lead counsel for a large-scale Indonesia retail company in SIAC arbitration proceedings seated in Singapore concerning change of control of a JV partner under the JV Agreement.
  • Representing an Asia-based conglomerate in disputes concerning hostile takeover of a joint venture company in Indonesia. This matter involves SIAC arbitration proceedings, multiple court cases and criminal investigations in Indonesia.
  • Representing a power company in defending 4 parallel court litigations in respect of hostile takeover of mining companies in Indonesia.
  • Representing various (both international and local) creditors in court proceedings to obtain bankruptcy/PKPU court orders against their debtors at the Jakarta, Surabaya, Medan and Makassar Commercial Courts. Most of these matters involve a complex settlement structure. 
  • Defending a number of high net-worth individuals in PKPU proceedings initiated by a major SOE bank.
  • Representing a major shipping company listed in Jakarta and Singapore as debtor in approximately USD 2 billion court-sanctioned debt restructuring process. The restructuring is multijurisdictional involving Indonesia, Korea, Singapore and US proceedings.
  • Representing a retail company in KPPU and court proceedings concerning predatory pricing.
  • Representing a local subsidiary of an Austrian rayon and chemical company in criminal investigation in respect of allegation of illegal dumping and mismanagement of B3 waste initiated by the Police.
  • Representing a chemical company in appeal proceedings against the District Court's judgment penalizing the company's director for violating the Environmental Law specifically for mismanagement of B3 waste.
  • Advising multinational insurance companies in relation to the claim arises from the slump of a Heap Leach Pad at the insured’s mine site under PAR policy.
  • Assisting a multinational insurance company on internal investigation in relation to massive data-breach of consumers to external parties.
  • Representing a US insurance company in disputes regarding D&O claims (including mediation, arbitration and regulatory examination by OJK).
  • Representing companies in termination process of high-ranking employees (including C-level/directors' level) at both the Industrial Relation Court and the District Court including defending the companies in police investigation process and the Manpower Office's audit initiated by the employees.
